The Appeal Court sitting in Kaduna today, upheld the election victory of the former Governor of Kano State, Senator Musa Kwankwaso, confirming him as the duly elected Senator, representing Kano Central Senatorial District.
The court threw out the appeal brought before it by Senator Basheer Garba of the Peoples Democratic Party (PDP) for lack of merit.
Garba and the opposition party had challenged the earlier ruling of the election petitions tribunal, which upheld the victory of the ex-governor of Kano, who contested the March 28 National Assembly elections on the platform of the All Progressives Congress.
In his ruling, Justice Habeeb Abiru, who delivered the lead judgement, said the APC complied with section 85 of the Electoral Act in giving the mandatory 21 days notice to the Independent National Electoral Commission of the primaries that led to the eventual emergence of Kwankwaso’s candidacy.
Justice Abiru, maintained that the ex-governor was properly nominated in the conduct of the election, adding that the wishes and aspirations of the people of the Central Senatorial District of the state was to have Kwankwaso as the Senator representing them.
On the appeal, the judge described the PDP and Garba as “meddlesome interlopers”.
He said the appeal was a mere attempt to use the machinery of the Appeal Court to get what the appellants could not get through the ballot box, dismissing the appeal for lack of merit.
