The Nigerian Presidency has officially released a revised list of inmates granted Presidential Clemency, following a significant public outcry. Bayo Onanuga, the Presidential spokesman, confirmed the updated list on Wednesday, revealing that numerous names have been removed from the initial roster. Earlier this month, the initial announcement of pardons, which included convicts on death row and those serving life sentences for serious offenses such as murder, drug trafficking, and illegal mining, had triggered widespread public outrage across Nigeria.
Public Outcry Leads to Presidential Clemency Review
The initial list of pardons faced immediate and strong criticism from various quarters. Former Vice-President Atiku Abubakar had voiced concerns that granting clemency to individuals convicted of grave offenses would erode public trust in the criminal-justice system and inadvertently "embolden criminality." Similarly, Mallam Bolaji Abdullahi, the National Publicity Secretary of the opposition African Democratic Congress (ADC), condemned the move as an abuse of the presidential power of mercy, labeling it a "national disgrace." Amidst this growing controversy, Prince Lateef Fagbemi, the Minister of Justice and chairman of the advisory committee, clarified that while clemency had been recommended, no convicts from the contentious list had been released, confirming that the list was undergoing further rigorous scrutiny due to the overwhelming public reaction.
Serious Criminals Excluded, Guidelines for Future Pardons
In a statement issued on Wednesday, Presidential spokesman Onanuga announced the removal of specific names from the pardon list. He stated, "President Bola Tinubu, GCFR, has executed the relevant instruments of release to complete the process of formally exercising his constitutional power of prerogative of mercy to grant pardon and clemency to specific individuals who were earlier convicted for various offences." The decision to delete certain persons convicted of serious crimes such as kidnapping, drug-related offences, human trafficking, fraud, and unlawful possession of firearms/arms dealing was made following consultations with the Council of State and public opinion. Other individuals on the original list had their sentences appropriately commuted. This decisive action was deemed essential given the gravity and security implications of these offenses, the imperative to be sensitive to the feelings of victims and society at large, the need to bolster the morale of law enforcement agencies, and adherence to bilateral obligations. The principle of justice, viewed as a three-way dynamic involving the accused, the victim, and the state/society, also guided this comprehensive review.
Reforms to Prerogative of Mercy Process
The approved list of eligible beneficiaries has now been transmitted to the Nigerian Correctional Service for immediate implementation. Furthermore, to ensure that future exercises meet public expectations and adhere to best practices, President Tinubu has directed the immediate relocation of the Secretariat of the Presidential Advisory Committee on Prerogative of Mercy from the Federal Ministry of Special Duties to the Federal Ministry of Justice. The President also mandated the Attorney-General of the Federation to issue appropriate Guidelines for the Exercise of the Power of Prerogative of Mercy, which will include compulsory consultation with relevant prosecuting agencies. These reforms are designed to guarantee that only individuals who fully satisfy the stipulated legal and procedural requirements will henceforth be considered for and benefit from the issuance of instruments of release. President Tinubu expressed his appreciation for the constructive feedback and engagement received from stakeholders and the general public on this critical matter, underscoring a commitment to transparency and accountability in politics.
